Health Care Law Final Exam Writing Assignment - 825 Words

Health Care Law: Final Exam Writing Assignment (Term Paper Sample) Content: Health Care Law: Final ExamName:St. Josephs UniversityHealth Care Law: Final ExamQuestion 1 (A): STATUTORY LAWThe state law to be evaluated in this paper is the law found in the Chapter 486.021 (11.a) of the Florida Statutes concerning the direct access of patients to physical therapists. According to this statute, the physical therapists in the state are allowed to access patients directly and implement their treatment plan for a period not exceeding thirty days. If the patient condition does not improve within the thirty days, the physical therapist should consult a healthcare practitioner (Florida Physical Therapy Association, 2017). The direct access law should be modified to prohibit physical therapists from accessing their clients directly and continue providing their services to the patients until they see the need to refer them to the healthcare practitioners. This is because the health conditions that prompted the patients to seek the services of the physical therapist could sometimes be a manifestation of serious health conditions (Ojha, Snyder, Davenport, 2014). The physical therapist should now be allowed to determine when the patient should be referred to the healthcare practitioners. Therefore, it would be important not to limit the number of days that a patient should seek the services of a physical therapist before being referred to a healthcare practitionerThe other law that is to be examined in this paper is Affordable Care Act (ACA). The ACA has played a vital role in improving access to healthcare for many Americans. However, some provisions of the act may need to be repealed to enhance its fairness and increase the number of individuals covered. One provision of the ACA that needs to be reviewed includes the tax credit system of the ACA. According to the current tax credit system of the ACA, the employment-based health insurance that is less than 9.66 percent of the familys income is considered affordable (Teitelbaum Wilen sky, 2017). This implies that an employee with a family would pay more than the recommended 9.66% of the income to cover the whole family (Teitelbaum Wilensky, 2017). To eliminate this "family glitch," it would be important to pass legislations that allow all the members of the family to have access to the Advanced Premium Tax Credit (APTC). This problem can also be fixed by only allowing the dependents to access the APTC subsidies. All the employees who do not have access to the affordable family coverage should be allowed to access subsidized coverage to the child-only policies (Howard Benshoof, 2015). Such initiatives would help in the elimination of unfairness in the ACA availed by the loophole in the Act.Question 2: (A). CASE LAWThe two case laws to be explored in this paper include the Zubik v. Burwell case and the National Federation of Independent Business (NFIB) v. Sebelius case. Both cases were concerning the interpretation of the Affordable care Act. Zubic v. Burwell c ase was presented before the Supreme Court of the United States (Lynch, Cohen, and Sepper, 2017). The lawsuit was meant to determine whether other religious organizations apart from the church were to be exempted from the contraceptive regulation adopted by the U.S Department of Human Services (HHS) as provided under the ACA. According to this provision of the ACA, all non-church employers are required to cover some contraceptives for their female employees. This exempted the church employers. The petitioners in Zubic v. Burwell case were the religious bodies that argued that this coverage violated the provision of the 1992 Religious Freedom Restoration Act. The court of appeal indicated that religious organizations were not able to show that the contraceptive mandate violated their freedom of religion (Lynch, Cohen, and Sepper, 2017). This case law should be modified to ensure that the employees of religious organizations are provided with contraceptive coverage. However, such orga nizations should be allowed to pay for contraceptive coverage or pay a certain amount to their employees to ensure that they pay the same if they wish. By doing so, all employees whose religious beliefs do not forbid the use of contraceptions will have the contraceptive coverage. In the NFIB v. Sebelius case, the Supreme Court of the United States gave the states the permission to opt-out the expansion of the Medicaid as provided by the ACA. Although Medicaid has increased the accessibility of healthcare by the Americans, many Americans have not yet received. The decision of the Supreme Court to allow the ...

Doing Soft Labor - 1272 Words

Doing Soft Labor When women, particularly young mothers, get together, occasionally the conversation will drift toward childbirth. You hear stories of long labors, mistakes made by doctors or nurses, cesarean sections, excruciating pain, complications, and so forth. Mothers are always eager to tell their horror story and will inform you of all the stories of friends and relatives, but sometimes, someone will come up with the story of the incredibly quick labor; and the woman who experiences that labor quickly becomes the envy, and most hated, of the group. Mom showed up two hours later and, after watching me wince in pain for two more hours, decided that, even though Dr. Rodermund told me to hold off coming in for awhile, it was time. She called the doctor back to tell them we were coming in, woke my husband, and drove us to Dr. Rodermunds office. Dr. Rodermund was reluctant to see me; my contractions were not steady and nowhere near five minutes apart, but took me in right away. Now, I want you to know that I felt pretty ridiculous because even I didnt think I was in actual labor yet, but who really wants to argue with their mom? So here I am in the examination room, nervous as heck, and a little embarrassed, when Dr. Rotermund looks at me, laughing, and asks me how I am feeling and how I got here. I answer with fine and my mom drove me only to be hit with a statement that is clear as a bell in my mind to this day. Get to the hospital right away and dont sneeze. You are fully dilated!. Oroonoko By Aphra Behn Essays - Novellas, Oroonoko, Aphra Behn

Oroonoko By Aphra Behn In Aphra Behn's Oroonoko, the author expresses her views on a African American slave openly and passionately, which in the Seventeenth century was unsuited for a person , let alone a woman, to do. By establishing the story from a first person account there becomes a juxtaposition of both author and character. By doing so the reader is able to feel more passion and anguish towards Oroonoko rather than through some fictional fable. Throughout the story Behn is also taking a stand for women's freedom of writing. Not only is she presenting facts based on an African American, she is taking the utmost liberty and honor in doing so, and in turn she is able to convince the readers of her time that Oroonoko is more than just a slave; he is a tragic hero. Aphra Behn gives herself the authority to write about the life of a slave, Oroonoko, due to her encounters with him and hearing from Oroonoko himself the story of his life. Behn establishes her authority within the opening lines and reminds her audience of her position as narrator by mentioning her personal role in the story. In the first few lines, Behn establishes her authority, "I was myself an eyewitness to a great part of what you will find here set down, and what I could not be witness of, I received from the mouth of the chief actor in this history, the hero himself, who gave us the whole transactions of his youth...." (Demaria Jr. 421) In this passage, Behn's portrays the authority of her subject matter. She uses first person perspective and declares that she was indeed a personal acquaintance of Oroonoko himself and received from him his life story. For the rest of Oroonoko's story, Behn was herself, "an eyewitness". This passage also clarifies that the author and narrator are one entity. Behn acknowledges that it is she who writes this story, through her own narration. In other words, the narrator is not only a character of the story, but the authoritative author. Behn proves herself to be a reliable source for the writing of Oroonoko due to the utmost respect she has for him as well as the trust he had for her. She praises his goodness while revealing turbulent times for the Prince that she had witnessed. Throughout the first half of the story, Behn maintains an air of authority through various devices. She speaks to her readers almost as if in an informal conversation, using contractions such as "'em". Behn also frequently uses asides such as in the following, "There is a certain ceremony in these cases to be observed, which I forgot to ask him how performed; but 'twas concluded on both sides that, in obedience to him..." There is a certain authority to be felt when one relays a personal story, even though they themselves may not be the principle character. This is exactly what Behn does. She draws her readers into an intimate account of a personal story. To strengthen her position, Behn's account is wrought with detail. One would assume that the readers of her time would be quite unfamiliar with her subject matter, so she seeks to enlighten with descriptions of detail. In other words, the narrator is not a character of the story, but the authoritative author. The reader is able to trust Behn's story as reliable since she was present for a majority of his life and talks of how she perceived him as well as how others treated him. The reader is guaranteed Behn's sincerity and honesty in writing the story when she declares " . . . and do assure my reader the most illustrious courts could not have produced a braver man, both for greatness of courage and mind, a judgement more solid, a wit more quick, and a conversation more sweet and diverting." (Demaria Jr. 424) Behn is not only captivated by the genuine and rare characteristics of his inner beauty, but his outer beauty as well and goes into detail of his handsome figure and beautiful facial features and the fine color of his skin. Around the time she wrote the story, it might not have been accepted by some people for a Caucasian women to admire the beauty of an African man and tell people about it. Behn takes a risk and therefore earns more of her readers' confidence that she is revealing as accurate an account for his life as she can. One would assume that the

Red from Green essay Essays

Red from Green essay Essays Red from Green essay Essay Red from Green essay Essay Red from Green essay BY benJ3164 Essay Red from Green All children need to undertake a Journey from being a child to an adult. For some, the journey goes very smooth and without any bumps, but for other it is a rough Journey. This is one of the most crucial themes in the novel Red from Green written by Maile Meloy. The novel describes a teenager named Sam who undertake the Journey of becoming a woman. The novel explains that Sam is out on a yearly float trip with her father, uncle and a client of her uncle. Sam is described as a slightly awkward teenage girl; She was awkward at fifteen, and praise made her suspicious. (p. l . ) The novel suggest, that she is not used to be complimented, and therefore she might have a low self-esteem. This low self-esteem could be a result of her complicated relationship with her father. Sam and her father has a distant relationship and we can assume this is because of the death of her mother. This important link in the family, which suddenly disappears, can lead to a lack of communication in the family. We can see this when neither Sam nor her father wants to talk about the boarding school; Everyone said what and opportunity it was, so much better than the local schools, but neither of them could bring themselves to talk about it. (p. 8. ) This lack of communication eventually leads to her taking more interest in another man who gives her attention. Layton presents himself as an alternative type of man, who appreciate her for being a women, however her father do not want to accept this and therefore still perceive her as a girl. Her father and Layton represent the separation in Sam. The part of her, which is still a child and the part of her, which wants to grow up. In additional the text displays the separation when she helps Layton with his back; The right side of her body was warm from the fire, the left side was cold. It was too cold at night to be wearing shorts (p. 1 1 The chilliness symbolize the part of her, which wants to grow up, in other words, the adult part of her. Where the warmth symbolize the part of her that still wants to be a child. Laytons relationship with Sam is purely based on his sexually intentions, which she discovers that evening; She was on one knee, half-straddling his back in the dust, and he rolled over, facing her. His hand slip up her leg to the small of her back and held tight. His eyes were cloudy and intent, focused and unfocused, and shed never seen a man look that way before (p. 1 . ) This encounter is a turning point for Sam, where she not literally, but in a symbolic way loses her innocence. We can see this after the encounter where Sam lies alone in her tent; She kept her hands between her thighs for warmth and the feeling there was sharp aching, but she didnt know what to do about it except lie awake, breathing until it went away (p. 12. ) The warmth in her body, which symbolize her childhood is vanishing, has almost left her body altogether. Her childhoods innocence blossoms one last time, in the end of the novel, where she talks to her father; She felt a flood f warmth for him, an overwhelming feeling that it was a mistake to go away. He she wanted to ask to make sure, but instead she took her dishes to the sink and the moment was over. (p. 12. ) The fact that she did not ask him why he left her with Layton, that evening and the warm feeling disappears, shows that her childhood is over. This brutal loss of innocence is the main theme in the story. We can also spot this in the title Red from Green, which symbolizes the loss of virginity. Another important symbol is the setting of the novel. The story takes place in the nature, hich can symbolize two different themes. The first is the natural sexual desires and instinct in the human brain. The second is the natural growth from child to adult. The main theme in the text is very typical in postmodern society. Many young teenagers like Sam, encounter some kind of crisis while growing up. If you use Red from Green as an example, there can be two separate reasons for this. The first is the change in the family pattern, like the death of Sams mother. The second is the many different choices young people have to take from an early age, like Sams choice of going to a boarding school.

Disscusion board (criminology) Essay Example | Topics and Well Written Essays - 500 words

Disscusion board (criminology) - Essay Example The doctor should have checked the man’s workplace conditions, his habits and other proclivities. A more detailed and in-depth examination would have revealed the cause. The doctor’s perfunctory approach resulted in the man ultimately suffering heart attack. There are cases where even after all standard examinations patients have had heart problems. The blood can clot without notice, block blood circulation in the heart and trigger heart attacks (Sardi, Bill). Heuristics is the â€Å"rule-of-the-thumb† analysis. Other than the standard examination, doctors apply their minds to other causes responsible for ailments like heart attacks. It is possible to apply heuristics in criminology as well. The study of criminology is not limited to law enforcement agencies alone. The medical line must also go into the social and mental causes of the crime (Zalman, Marvin; 1981) In this case, although the patient had fever and was experiencing discomfort, the doctor could not find the cause for the fever. The next day the patient suffered severe infection on the side of the body the doctor did not examine. Maybe the doctor was tired and called it a day. Even then, in medical parlance, this is medical malpractice. The doctor could be legally taken to task for this lapse (Doctor Negligence, 2010) Doctors as well as criminologists need to be open to all options. There may be situations when nagging doubts and lack of evidence evade solution. A doctor who is too tired to attend to patients must have fresh replacement to attend to the patient. In most cases, a criminologist gets enough evidence or witnesses to make his case. In difficult and/or complex cases, a criminologist can only wait for the courts to decide the

The NHS Essay Example | Topics and Well Written Essays - 1750 words

The NHS - Essay Example This free treatment policy of the NHS needs to be revised, as this is not only unfair to the taxpayers but is likely to bring economic collapse to the NHS budget with the increasing number of diabetic and cancer patients (Hardman, 2012). Diseases of lungs cancer, diabetes, and metabolic syndromes are the ones which require expensive and prolong medical treatment. Lungs cancer is the most known form of cancer which can cause malfunctioning lungs of patients and could also result in a painful death. Doctors researching on this ailment have clearly stated that 90% of the lung cancer is due o cigarette smoking or tobacco consumption. As the number of active smokers have increased, so is the rate of lung cancer, and there is no other major factor contributing to this disease (Groves, 2012). Report of the American Lung Association on world diseases, reveals that the among all cancer deaths including Breast and Colon cancer, lung cancer has the highest number of deaths (American Lung Associ ation, 2013). In the course of just 50 years, this disease has taken lives of more than 6.5 million people in the UK alone. The major reasons for this is the contribution of globalization, which has hundreds of cigarette, cigar and tobacco manufacturing companies, which has decreased the prices of these drugs and has made it easily accessible to everyone (Cancer Research UK, 2012). The other reason is the lack of government attention on this matter and the failure of introducing applicable and futuristic policies. In the ongoing debates to whether the NHS should change its funding and free treatment policies for lung cancer patients, these facts can provide a firm ground to the argument of restricting those funds. In this regard, Phillip Lee, a GP practitioner, raised the point that if the government kept paying for smokers and diabetic patients, it is in a way encouraging other smokers. He said in the NHS conference (2012) that people are free to consume whatever they wish for, but only at the cost of their own money. If the NHS is not going to cut down the treatment expenses funded to the smoking patients, then there is no way the country will get rid of smoking health disorders (Groves, 2012). It is evident from these facts that the disease of lung cancer is due to the bad appetite choice and smoking habit of the patient. Moreover, these people have harm the health of other people in their surroundings, as anyone who inhales the smoke of cigarette is also affected to some extent. Medical researchers have outlined the fact that passive smokers, the ones who are exposed to cigarette smokes of a smoker, have more chances to develop lung cancer than those who are not (Groves, 2012). This explains that smokers have not only put their lives on risks, but also the lives of many others who come in the vicinity of their smoking zone. One encouraging fact for these smokers is their free treatment from the healthcare budget of the country (Groves, 2012). The purpose o f providing free medical treatment to patients is to help those who cannot afford for the medical expense of their diseases or disorders, which have developed naturally or accidently and they are not the ones responsible. Providing this facility to lung cancer patients will not make them realize their act of ignorance and immorality. Therefore, if individuals who are addicted to smoking or tobacco are

Apple Swot Essay Example for Free

Apple Swot Essay Apple is a brand which is being recognized for good reasons through out the world. â€Å"Brands are unlikely to become successful if their end motive is simply to be different, consumers demand that brands become different in a meaningful way which means delivering on that difference† (Helen Fern 2010). Apple has a great sense of creativity especially in connecting with consumers and this can be seen from the fact that even the most generic products can still be perceived to be different. There are many smart phones out there in the market but the iphone is the most recognized today. From the fact that Apple maintains a good range of products which compliment each other from the itunes online store which is an excellent source of revenue derived from sales of music and applications for Apples iphone, ipod and ipad touch devices, this is bound to bring good customer loyalty buying multiple products from Apple, some of whom may well be influenced by other people as Apple seem to have an aggressive presence on the social media networks such as facebook and twitter where the majority of consumers spend a lot of their time these days. This increases further awareness and adds strength to the brand. Apple has not in many years use celebrities to strengthen its brand which is a great deal in saving money. Instead it is the celebrities who tend to use Apple now in order to increase their income and diversify their business. This in return increases the strength of the brand almost effortlessly. A good example to this will be the Will i.am iphone cases. â€Å"Will.i.am has officially unveiled four â€Å"i.am † iPhone cases, designed to improve the Apple smartphone’s camera capabilities. The Black Eyed Peas frontman took to London’s Selfridges department store to show off the â€Å"foto.sosho† range, with the press release claiming the device, which comes in several variants, to be â€Å"the world’s first digital camera accessory and app combination designed to turn an iPhone 4 or iPhone 4S into a sophisticated point and shoot digital camera.† http://www.trustedreviews.com/news/will-i-am-launches-i-am-foto-sosho-iphone-cases Apple has won several awards in recent years and has been â€Å"voted the  overall winner of the 2012 CMO survey awards for marketing excellence, yet again Apple has been selected as a winner or co winner for five consecutive years by the sample o0f top marketers†. Christine Moorman 2012. Apple had originally followed the following points in order to create success. * Epathy – Making sure that customers needs are truly been understood more than any other company in this competitive industry. * Focus – Time management in terms of eliminating unimportant opportunities therefore a good job can be done on the chosen tasks for example deciding what to produce and then focusing on product differentiation from other producers. * Impute – Product presentation is of high importance since people always judge a book by its cover therefore, high quality product and most usefull software has to be presented in a creative proffessional manner. A Unique Approach: Education in Public and Charter Schools Essays

A Unique Approach: Education in Public and Charter Schools School choice: two words that together spell out a multitude of educational options for students today. Among them are charter schools and public schools; public schools standing the test of time and charter schools being at the forefront of a revolution in educational change. Surprisingly, these two educational institutions have more in common than one might think, but maintain their differences. Key differences between charter and public schools include approach to education, funding, level of government involvement, and enrollment practices. Despite these differences, both charter and public schools share the following features: free of charge to students, required to demonstrate adequate yearly progress on state standardized tests and status as public institutions. Charter schools are educational institutions that share common features with public schools and at the same time have key differences that make them unique. Charter schools and public schools share a definition as public educational institutions; however, there remain key differences within this explanation. Charter schools are independent public educational institutions that have the freedom to operate within a specific educational focus, such as math and science or agriculture science. (WestEd, 2010) Within the context of this specific educational focus; charter schools tailor curriculum, assessments, program goals, and measures of achievement towards the students their charter serves. (WestEd, 2010) Unlike charter schools, public schools are educational institutions that operate under the direction of a school board along with state and federal government whose rules and laws sanction their daily ope... ... and federal government on a per pupil enrollment basis, however do not have the luxury of levying taxes that public schools do. Federated Science Fund Negotiation Essay

Summary: This was a multiparty negotiation, which involved 6 players all with very different negotiation styles. It was an exercise in which teams easily form a coalition. There were concessions about the value added each team would bring to the â€Å"table†, and my team in a situation of power saw how negatively the other teams reacted in name of fairness and how important was to share the pie. During this exercise there was a 3-stage process: individual assessment, team’s assessment and negotiation. 1) During my individual assessment: I did a thorough analysis of what I believed it was Stockman’s fair value. My reservation price was $215,000 as I did a mean value between 230,000 and 197,000. However I was prepared to accept 197,000 in case my counterparties had convincing arguments or/and have used the Sharpley’s method for distributing the pie. 2) During Stockman’s assessment, my team: My partner was comfortable with my analysis and we rapidly agreed on the strategy. He was very favorable of having a cooperative attitude. As a team, we decided to start negotiating as a group of 3 in order to expand the pie to everyone. 3) During the teams’ assessment when we reassembled: There was a consensus that we were better off together than separately, and we decided to do a simultaneous negotiation in order to guarantee that no one was left out of the deal. Everyone wanted to have an even participation. There were two main breakpoints that change the course of the negotiation: the anchoring and a vertiginous switching of power positions. What did I do right? – I did the anchoring of the thought process; I presented the scenario that was more favorable to Stockman, my team. As below:   Ã¢â‚¬â€œ I Assumed that 480 total was the fair value and started backwards by subtracting the added-value from the person that left the deal. Based on this analysis Stockman was the biggest contribution to the pie, it represented 56.25% of the conjunct agreement. – United was not receptive to this deal, and they were not impressed that at my eyes they were worth only 12.5%. United instantly turn to Turbo for a deal. That attitude was surprising to me as I was expecting a more aggressive tactic of United to do a collision with Stockman. – My initial splitting did not convince United and Turbo as in total they had less than partnering together. I knew and acknowledged that, so I offer Turbo and United some of my 270 share. That was the right thing to do, however I should have reclaimed something in exchange. One should only give up a share of the pie if it has something in return. â€Å"Free lunches turn out to be expensive lunches† in the means that people will always ask for more if they don’t feel they need to compromise. – I was not favorable at all to divide equally the pie. I knew my value and was determined to not let go what I considered my fair bit. What did I do wrong? – I started to get nervous and eventually I panic when I realized that Turbo was starting to be more interested to negotiate with United. United in the midst of an angry Turbo, took advantage and ask for a bigger pie to continue with Stockman. This was a crucial moment, which I internally panic. I should have asked for a break and set again my direction with my partner. Internally I needed â€Å"some minutes in the balcony†, to decompressed. – When I saw that Turbo and United were building up forces, I put in a table a completely new negotiation, which was very disruptive, compared to the previous one: – In this negotiation scenario, United saw their share increasing from 60 to 90 and Turbo would remain more or less the same. Turbo felt berated and betrayed, based on the equity theory they did not accepted and demanded for more. – I learn a big lesson, never radically change negotiation positions. Doing such a radical change underestimates the seriousness of your previous arguments and injures radically your position. One should take the time to negotiate and not feel compelled to do quick decisions. In this particular exercise I should have listened more. I got exposed for trying to control and leverage my position of power. Nevertheless, I managed to do a deal still within my initial reservation price. What would I like to do different? – My Stockman partner was sitting on the bench next to United I guess that made me feel in a certain point of the negotiation isolated. Adding to that, I was the only one in the negotiation with calculations and without my phone to add up and do the recalculation of the values on the spot. – I would mirror the behavior of my colleagues next time, if no one shares calculation sheets I will not show any that I have made. Next time, I will push myself more to be more spontaneous and try to use more persuasive arguments than analytical calculations during the negotiation. – Next time I will listen more and try to understand what is considered as â€Å"fairness†, for instance United just being part of the deal might have been fair per se. I lost a good opportunity to stay only with my first analysis and just duel on a psychological construct that United was a small company that developed research in an area that was not Stockman’s main interest, so being part of the deal for United was already a bonus. (I had a better relationship with Turbo). – At the end of the negotiation I just wanted to protect my reservation price at all cost, I lost control and got in the frame of the yes bias. Maybe I am not as much of a risk taker as I thought I was. – Next time, I will get in line with the intentions of my counterparty and announce my intentions and which are the concessions that I think are reasonable. It is always good to start conceding little and slowly progressively do some concessions. People love to feel they are doing progress in their negotiation and it should be gradual – higher satisfaction for the people involved. – It was good to have done an analytical analysis, however next time I will not share entirely my thought process. I should have used my good planning for my advantage during the negotiation.
